Wewenang tim penilai (appraisal) dalam menentukan nilai limit lelang hak tanggungan terdapat dalam Peraturan Menteri Keuangan Nomor 27/PMK.06/2016 Tentang Petunjuk Pelaksanaan Lelang Pasal 44. Dalam pasal tersebut disebutkan bahwa penjual dalam menentukan nilai limit harus berdasarkan penilaian dari penilai (appraisal), dan penetapan nilai limit tidak menjadi tanggung jawab KPKNL atau pejabat lelang kelas II. Dalam Peraturan Menteri Keuangan Nomor 27/PMK.06/2016 Tentang Petunjuk Pelaksanaan Lelang juga dijelaskan bahwa lelang eksesuksi hak tanggungan yang nilai limitnya paling sedikit Rp. 1.000.000.000 (satu miliar rupiah) penjual dalam menentukan nilai limit harus berdasarkan laporan penilaian dari penilai (appraisal) secara tertulis. Namun tidak ada peraturan yang mengatur mengenai penjual harus menggunakan penilaian dari penilai (appraisal) yang terdaftar pada Kementrian Keuangan Republik Indonesia, dalam Peraturan Direktur Jendral Kekayaan Negara Nomor PER-03/KN/2010 tentang Petunjuk Teknis Pelaksanaan Lelang Pasal 18 hanya menyebutkan bahwa penjual harus harus menggunakan penilaian dari penilai yang sudah terdaftar pada Kementrian Keuangan Republik Indonesia dalam hal bank kreditur akan ikut menjadi peserta lelang pada lelang eksekusi hak tanggungan.

Abstract

 

The authority of the appraisal team in determining the limit value for auctioning mortgage rights is contained in the Minister of Finance Regulation Number 27 / PMK.06 / 2016 concerning Article 44 Implementation Guidelines. In the article it is stated that the seller in determining the limit value must be based on the appraisal ), and determination of limit values is not the responsibility of KPKNL or class II auction officials. In the Regulation of the Minister of Finance Number 27 / PMK.06 / 2016 Concerning the Auction Implementation Guidelines, it is also explained that auction for mortgage rights with a limit value of at least Rp. 1,000,000,000 (one billion rupiah) of the seller in determining the limit value must be based on the assessment report of the appraisal in writing. However, there are no regulations governing the seller must use the appraisal rating registered with the Ministry of Finance of the Republic of Indonesia, in the Director General of State Wealth Regulation Number PER-03 / KN / 2010 concerning Technical Guidelines for the Implementation of Article 18 only states that the seller must must use the judgment of the appraiser who has registered with the Ministry of Finance of the Republic of Indonesia in the event that the creditor bank will participate as an auction participant in the auction for the execution of mortgage rights.
