THE TRANSFORMATION OF ENGAGEMENT PRACTICES PINANG MEMINANG IN MALAY MARRIAGE: AN ISLAMIC FAMILY LAW PERSPECTIVE IN ANAMBAS ISLANDS

This study examines the transformation of the pinang meminang tradition in the marriage practices of the Malay community in Kiabu Village, Anambas. Traditionally, pinang meminang functions as a cultural mechanism to affirm marital intentions and establish agreements between families. However, socio-economic changes have influenced its implementation within the context of contemporary society. This study is analyzed from the perspective of Islamic family law by employing the theory of ‘urf as a living tradition within society and maqāṣid al-sharī‘ah to assess the objectives and benefits embedded in the practice. This research employed a qualitative approach through interviews and observation. The findings indicate that the transformation of pinang meminang does not signify the disappearance of tradition, but rather represents a form of social adaptation to changing times. Despite procedural changes, the practice continues to maintain its social meaning as a symbol of legitimacy and reinforcement of family ties and can be categorized as ‘urf ṣaḥīḥ as long as it does not contradict the principles of Islamic law. This study contributes to enriching Islamic family law studies, particularly in understanding the relationship between local traditions and Islamic law within the context of legal pluralism.
