ANALISIS HUKUM INTERNASIONAL TERKAIT DEFORESTASI DAN HAK-HAK MASYARAKAT ADAT HUTAN AMAZON DI BRAZIL

Abstract

 

Penelitian ini mengkaji tentang analisis hukum internasional terkait deforestasi dan hak-hak masyarakat adat hutan amazon di brazil. menganalisis perlindungan hak-hak masyarakat adat dalam menghadapi kebijakan presiden Bolsonaro dalam Hukum internasional serta kebijakan dan upaya negara-negara internasional dalam penanggulangan deforestasi di hutan amazon Brazil. Penelitian ini menggunakan tipe penelitian yuridis normatif dengan menggunakan pendekatan Perundang- Undangan (Rome Statute of the International Criminal Court). Dimana upaya atau tindakan dalam perlindungan masyarakat adat hutan amazon Brazil dalam hukum internasional yaitu Melalui dukungan hukum internasional dengan memberikan sanksi atau kekerasan melalui intervensi dan penyelidikan penuntutan dari pihak komunitas internasional dan penyelidikan oleh Kantor Kejaksaan ICC akan menjadi kepentingan keadilan, kendala yang dihadapi dalam tuntutan ini adalah Mempertimbangkan prosedur panjang dan rumit yang ditetapkan oleh Konstitusi Brasil untuk menuntut Presiden Bolsonaro dan mengingat bahwa pengadilan belum melakukan langkah-langkah yang berkualitas untuk menjelaskan situasi saat ini, ada alasan untuk percaya bahwa jika Negara Brasil akan memulai penyelidikan, investigasi tidak akan memenuhi syarat sebagai 'asli'. Landasan kedua untuk dapat diterima adalah gravitasi tes, yang mengacu pada Pasal 17 (1) (d) dan Pasal 53 (1)Statuta Roma. Semua kejahatan di bawah yurisdiksi ICC adalah “kejahatan paling serius†yang “mengancam perdamaian, keamanan dan kesejahteraan duniaâ€. Kemudian dalam menekan pemerintah Brazil terkait deforestasi negara-negara akan membahas Proposal kebijakan perlindungan hutan amazon Brazil yang dicanangkan pada awal tahun 2021.

This research examines the analysis of international law related to deforestation and the rights of indigenous Amazonian forests in Brazil. analyze the protection of the rights of indigenous peoples in the face of President Bolsonaro's policies in international law and the policies and efforts of international countries in tackling deforestation in the Brazilian Amazon forests. This research uses type normative juridical research using the approach Legislative - Invitation ( Rome Statute of the International Criminal Court). Efforts or actions in the protection of Brazil's amazon forest indigenous peoples in international law, namely through the support of international law by providing sanctions or violence through interventions and prosecution investigations from the international community and investigations by the ICC Prosecutor's Office will be in the interests of justice, the obstacles faced in this lawsuit are to consider the long and complicated procedure established by the Brazilian Constitution to prosecute President Bolsonaro and given that the court has not undertaken quality steps to explain the current situation, there is reason to believe that if the Brazilian State were to initiate an investigation it would not qualify as' genuine '. The second basis for acceptance is the gravity test, subject to Article 17 (1) (d) and Article 53 (1) of the Rome Statute. All crimes under the jurisdiction of the ICC are "the most serious crimes" that "threaten world peace, security and welfare". Then In asking the Brazilian government regarding deforestation, the countries will discuss the Brazilian Amazon Forest Protection Policy Proposal launched in early 2021.
