Reconstruction of the Child-Centered Approach Model Through Evaluation of Parental Alienation Practices in Custody Disputes in Indonesia

One phenomenon that often arises in custody issues is parental alienation. This study aims to examine the phenomenon of parental alienation in the context of several decisions by Religious Courts in Indonesia. The research uses a normative juridical research method with a conceptual, legislative, and case approach. The results of the study show that parental alienation hurts the psychological condition of children as victims of divorce, so a strategy that prioritizes the interests of the child is needed. As a solution, this study proposes a child-centered joint custody model that can be pursued through two channels: amending several articles in the Compilation of Islamic Law to regulate joint custody as an option alongside sole custody, and technical arrangements through Supreme Court policies in the form of Supreme Court Circular Letters and Supreme Court Regulations on the parameters for implementing joint custody, such as the emotional stability of the parents.
