Integrating Constructive Res Judicata into Indonesian Civil Procedure Law: Lessons from India

Abstract

The large number of civil cases in Indonesia raises questions about the effectiveness of the res judicata principle in providing finality in disputes. Article 1917 of the Indonesian Civil Code governs the binding force of decisions, but it does not explicitly include the concept of constructive res judicata, leaving the possibility of repeated lawsuits with different claims open. This research analyzes the regulation of res judicata in Indonesian civil law, compares it with Article 11 of the Indian Code of Civil Procedure 1908, and formulates a model for integrating constructive res judicata that is relevant for Indonesia. The method used is doctrinal legal research with a legislative, conceptual, and comparative approach. The research findings indicate a regulatory gap that could undermine the finality of a decision. The integration of this doctrine is important for strengthening certainty and justice and enhancing the efficiency of the judiciary.
